Its a shame that a section of gaming fans have to pay a little extra to have the wireless controllers but I'm sure they will argue that its worth the money.

I don’t get it. Why do so many people hate Walmart? I’m actually a big fan of Walmart. They offer some of the most competitive prices for nearly… everything! Walmart is the single biggest employer in the United States. It employees well over 1 million workers, and gives them the option to opt into a health care program. Wal-Mart pays an average full-time hourly worker of $10.11 an hour, according to independent expert statistical analysis*. That’s nearly double federal minimum wage of $5.15 an hour. Let’s analyze Walmart a bit further by looking at the usual complaints and responding to them.

Complaint: Walmart drives out competition! They’re evil! My Response: Walmart beats the competition. They offer the same product at a cheaper price. That means they are more efficient then their competitors. Since when was being successful a crime? Let’s look at a scenario. Let’s pretend YOU made a new website. Let’s say your new website competes with Google. Your new website is amazingly efficient, user friendly, and always gets the best search results. You start making millions of dollars. Your new website is absolutely phenomenal. Whenever someone searches something, they always find exactly what they’re looking for. You managed to do this because you spent countless months developing your new search engine. Your new website also gets praise from the entire country for being such a resourceful website. However, due to the result of your new success, you managed to bankrupt both Google and Yahoo by offering cheaper rates. Did you do anything wrong? Absolutely not! You created a BETTER product then your competitors, and in result, they had to close down, because they couldn’t adapt to their new competition. This is exactly what Walmart did. They created an extremely efficient method of getting products and putting them on the shelf at low costs.

Complaint: Walmart strong-arms its suppliers for the lowest possible prices. My Response: Why should Walmart pay the same price for a TV as Joe’s electronics? Walmart purchases 1,000,000 TVs at once, while Joe’s electronics purchases 5. The truth is that suppliers love Walmart. (source below). Why wouldn’t they? When you talk about transactions, you have to understand basic economics. Whenever a transaction occurs, both parties always benefit. If that wasn’t the case, the transaction would not have occurred. Lets look at the most basic example. When I purchase a gallon of milk for $2 at 7-Eleven, I clearly want the milk more then I want the 2$. The 7-Eleven clearly wants my 2$ instead of the gallon of milk. Whenever Walmart needs to restock, they contact their suppliers and negotiate a price. If both parties agree, the order is fulfilled. If the supplier cannot agree on a price with Walmart, the supplier has the option to decline. Walmart will then seek a different supplier to get the order filled. If no supplier will fulfill Walmart’s order, Walmart will most likely raise its offer and try to negotiate once again with its suppliers. Is this penny pinching method evil? Of course not! Walmart is trying to get the best deal possible. Since when was that ever a despicable act? A consumer usually checks the price on higher tag items at multiple retailers before making a purchase, why shouldn’t Walmart do the same thing?

Complaint: Walmart is a monopoly! My Response: Walmart is not a monopoly. Anyone can compete with Walmart. If you want to talk about monopolies, take a look the United States Postal Service or PSEG. If you compete with the Postal Service on non urgent first class mail you will get locked up. You won’t get locked up for competing with Walmart. Walmart currently has fewer than 10% market share for retail in the United States. Hewlett Packard (HP) currently has a 16.9% worldwide market share in the personal computer market, why aren’t they labeled a monopoly? Intuit, the maker of QuickBooks, has a 73.9% of the accounting software market, and they aren’t criticized nearly as much as Walmart is. Where do the complaints really come from? The consumers? No way! Walmart serves over 100 million customers each week. They wouldn’t keep coming back if their experience wasn’t satisfactory.

Lack of Fully Equipped Training Facilities and Equipment

A simple comparison of the average gymnastics and the average cheerleading training facility shows how poorly the average cheerleading training facility is equipped. Many cheer programs have no specialized training facility at all and many have no or minimal equipment. This makes learning cheerleading skills more difficult, dangerous and creates inconsistent skill performance.

Untrained Coaches

Perhaps the number one reason for the high injury level is the prevalence of untrained and inexperienced coaches. It is not that uncommon for school cheerleading programs to only be required to have a faculty advisor, with no requirement for that faculty member to have any cheerleading experience at all. This results in jr. high and high school age athletes being completely responsible for their own training - obviously an unsafe situation. Often school programs have cheer "sponsors" not cheer coaches, a verbal recognition that the program leader has no cheer coaching expertise.

Coaching Inexperience

Even former cheerleaders may not have enough experience to safely coach the new level of difficult skills that are being performed in cheerleading. Former cheerleaders who only performed simple to moderately difficult sideline and half-time skills are not experienced in teaching the high level competitive cheerleading skills now being done.

Poor Pay

One of the primary reasons for the prevalence of both untrained cheer coaches and more widely experienced coaches is the sometimes ridiculously low pay remunerating cheer coaches or sponsors. There is no financial incentive for coaches to spend their own money for training when they know they will never be able to recoup their investment.

Poor Spotting

Inherent in certain aspects of cheerleading is that cheerleaders spot other cheerleaders. They do so in basket tosses, stunting and pyramids. One of the basic tenets of gymnastics coaching is that only professional coaches are qualified, mature and experienced enough to spot gymnasts. Cheerleading depends on athletes of the same age and experience level to take responsibility for the lives of their cheerleading teammates. This is certainly dangerous to at least some degree and that danger must be recognized. Spotting requires deep concentration, commitment and taking personal responsibility for the safety of the cheerleader being spotted. Simply assigning an increasing number of youthful spotters does not solve the problem.

Lack of Necessary Conditioning and Strength Training

The need for adequate strength training and physical conditioning is recognized in most sports programs. It is also understood that practicing most sports does not provide sufficient strength training and physical conditioning. Too many cheer programs contribute and compound an already unsafe situation by not adequately building the strength and fitness levels of their athletes.

Not Using Proper Skill Progression

Proper skill progression is a tenet of gymnastics training programs. It is only logical that basic skills be learned and mastered in safe small steps. Too many cheer programs rush through progressions or skip them entirely. Many cheerleading coaches and cheerleaders are even unaware of the progressive training steps they should be following. There are safety and skill progressions for tumbling, stunting, pyramids and basket tossing. This is definitely an area where ignorance contributes to the danger.

Competing Skills That Have Not Been Mastered

The emergence of the new competitive aspects of cheerleading and the increasing numbers and importance of cheer competition hve placed pressure on cheerleaders and cheer coaches to increase the difficulty of the skills they are performing. Under the guidance (?) of inexperienced and untrained coaches/sponsors, safely learning to perform these more difficult and more dangerous skills is not surprisingly inconsistent.

Legislation

The Indian law of patents is enshrined in the Patents Act, 1970. The Act seeks to provide for legal protection for inventions. The rights granted under the Act, are operative in the whole of india.

What is a Patent

A Patent is an exclusive monopoly granted by the Government to an inventor over his invention for a limited period of time. It provides an enforceable legal right to prevent others from exploiting an invention. Invention as defined under the Act to mean a new product or process involving an inventive step and capable of industrial application.

Rights conferred by registration

Patents represents one of the powerful intellectual property right. The registration of a patent confers on the patentee the exclusive right to use, manufacture or sell his invention for the term of the patent. It means that the invention cannot be commercially made, used, distributed or sold without the patentee's consent. The patent rights can usually be enforced in a court of law.

Who Can Apply For A Patent

An inventor or any other person/company assigned by the inventor can apply and obtain the patent over the invention. A patent is obtained by the inventor or his assignee by filing an application with the appropriate office of the patent office in stipulated forms and fees as required by the Act.

Patent Search

It is prudent to conduct searches as early as possible to avoid spending time and money re-inventing a known matter. A patent is not granted to an invention if it is already available with the public either in the form of published literature or common knowledge.

Patentable Inventions

To be patentable, an invention must, in general, satisfy certain criteria. The invention must be of industrial applicability, must be new and must show an inventive step which could not be deduced by a person reasonably skilled in the field. Above all, its subject matter must be accepted as "patentable" under law. As for example, Inventions which are frivolous or claim anything contrary to well established natural laws are not patentable. There are also other specific categories of inventions which are declared as non-patentable.

Patent Specification

The process of patenting typically involves conducting prior art searches to distinguish the invention and develop a description that illustrates the best method of working the invention. The description of the invention is called specification. Depending upon the sufficiency of the descrption a specification may be either provisional and complete Specification.

Provisional and Complete Specification

A provisional specification is often the first application filed in respect of an invention, and usually contains only a brief description of the invention. It need not contain claims. Compared with the provisional, the complete specification contains the full description of the invention, and the best method of making the invention work. The complete specification comprises a title, field of invention, the background of the invention, the description of the related art, drawbacks of the prior art, the summary of the invention, the brief description of the figures, the detailed description of the preferred embodiments, claims and abstract. Complete specification must be filed within 12 months from the date of filing of the provisional specification.

Claims are the most important component in the patent specification as it is the legal operative part which define and determine the legal protection sought for. The extent of patent protection for an invention shall be determined by the terms of the claims. The description and the appended drawings may be used to interpret the claims.

Filing and Prosecuting Patent Applications

The procedure for the grant of a patent starts with filing of the patent application along with the presribed fees at the appropriate office* of the patent office followed by filing of request for examination in the prescribed format (present time limit within 36 months), after the publication of the application. Presently, application for patent is not open to open to public for 18 months from the date of filing or date of priority, though the applicant can request for early publication. The applications are examined substantively and a first examination report stating the objections is communicated to the applicant. Application may be amended in order to meet the objections. Normally all the objections must be met within 12 months from the date of first examination report. If the applicant does not comply with the objection, the application will be abandoned. Upon complying the requirements the application is published in the Official Journal. At that time, opposition can be filed on limited grounds, but hearing is not mandatory. Patent will be granted if the application is found to be in order. Then, the application and other related documents will be open for public inspection. Thereafter, at any time after the grant but before the expiry of a period of one year from the date of publication opposition on substantive grounds is available. The whole process typically takes at least two years.

Duration of a Patent

The term for patents is 20 years from the date of filing of the application for the patent. It is the responsibility of the patentee to maintain an issued patent by paying the annuities until the patent expires. After 20 years term the invention claimed in the patent falls into the public domain.

Restoration

Restoration of a patent that lapses due to non-payment of renewal fees can be made within one year of lapse. However, certain limitations will be imposed on the rights of the patentee when the patent is restored.

Remedies For Infringement

It is the sole responsibility of the patentee to see that his patent is not being infringed. It is the patentee's duty to file a suit of infringement against the infringer. The reliefs which may be usually awarded in such a suit are -

i. Injunctons whether interim or final.

ii. Damages or account of profits.

International Patent Protection

There is no international or world patent. An inventor has to file an application in each country, where he seeks to protect his invention. However, there are regional and/or International treaties to facilitate the procedure to seek protection like Patent co-operation Treaty (PCT) or European Patent Convention (EPC).
